A mentally disabled man was allegedly assaulted by a staff member of a Newport News assisted living site. His sister is now suing the home, citing nursing home abuse and accusing it of negligence in hiring the worker in the first place.
The suit states that Cote De Neige Home for Adults and its howner, Rose Daniels Potter failed to provide reasonable care by hiring Junious Boyd Batten for a job as a certified nursing assistant. The lawsuit says that the home should have been particularly cautious, because of the "weak and helpless" condition of the residents.
Battan is facing five forcible sodomy counts, three carnal knowledge counts and one abuse and neglect count involving the victim.
"He got on top of me and...do something wrong, something he was not supposed to be doing," said the first mentally disabled man.
Appallingly, the civil lawsuit includes a list of 13 criminal offenses that Batten was charged with before or during the time, he worked at Cote De Neige. He was found guilty of public intoxication, two assault and battery charges, and a contempt of court charge.
